Commercial license changes

I’ve got quite a few questions over last few months about what “derivative works” means in WebLaF commercial license agreement – it is true that this statement is unclear and might be interpreted differently. Under that statement I always meant any look and feel library written based on WebLaF and it hasn’t changed.

To avoid further misunderstandings and make the agreement transparent I have added a few changes which you can find under the cut.

This post purpose is to ensure that everyone are aware of these changes and of the fact that nothing will actually change for commercial WebLaF users. These changes will not cancel or affect any freedoms granted by the agreement anyhow and are only focused on making agreement more convenient.

Here are the changes made to commercial license agreement:

1. RIGOROUS ENFORCEMENT OF INTELLECTUAL PROPERTY RIGHTS.

Before modifications:

If the licensed right of use for this WEBLAF is purchased by you with any intent to create derivative works, and unauthorized exploitation or transfer of any ALEE intellectual property and trade secrets no licensed right of use shall exist, and any products created as a result shall be judged illegal by definition of all applicable law. Any sale or resale of intellectual property or created derivatives so obtained will be prosecuted to the fullest extent of all local, federal and international law.

After modifications:

If the licensed right of use for this WEBLAF is purchased by you with any intent to create derivative look and feel libraries, and unauthorized exploitation or transfer of any ALEE intellectual property and trade secrets no licensed right of use shall exist, and any products created as a result shall be judged illegal by definition of all applicable law. Any sale or resale of intellectual property or created derivative look and feel libraries so obtained will be prosecuted to the fullest extent of all local, federal and international law.

 

3. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.

Before modifications:

A. Not for Resale Software. The WEBLAF is labeled and provided as “Not for Resale” or “NFR”, then, notwithstanding other sections of this SLA, you may not resell or otherwise transfer for value or benefit in any manner the WEBLAF or any derivative work using the WEBLAF.

After modifications:

A. Not for Resale Software. The WEBLAF is labeled and provided as “Not for Resale” or “NFR”, then, notwithstanding other sections of this SLA, you may not resell or otherwise transfer for value or benefit in any manner the WEBLAF or any derivative look and feel library using the WEBLAF.
